Purpose
This document sets out the contractual terms governing Carvado Membership.
It applies to all Membership Tiers offered by Carvado unless expressly varied by a tier-specific document, including the Elite Black Terms.
It explains the rights and responsibilities of both Carvado and Members and should be read together with the additional Membership Legal Centre documents referred to throughout this document.
Where another Membership Legal Centre document expands upon a particular subject, that document should be read alongside these Terms.
Nothing within this document is intended to remove or restrict any statutory rights available to consumers under applicable law.
GENERAL RULES OF INTERPRETATION
Unless the context otherwise requires:
(a) words importing the singular include the plural and vice versa;
(b) references to one gender include all genders;
(c) headings are included for convenience only and do not affect interpretation;
(d) references to legislation include any amendment, replacement or re-enactment of that legislation;
(e) references to "including", "include" and similar expressions are illustrative only and shall not limit the meaning of the preceding words.
The General Rules of Interpretation form part of CAR-LGL-001 only.
Do not duplicate those interpretation clauses within the remaining Membership Legal Centre documents unless the supplied wording expressly includes them.
WELCOME
Welcome to the Carvado Drivers Club.
Thank you for choosing to become a member.
Drivers Club has been created for people who expect more than simply arranging insurance once each year. It is designed to provide ongoing support throughout your ownership journey by giving members access to specialist knowledge, insurance reviews, digital resources, member-only benefits and additional services which may become available over time.
These Membership Terms and Conditions form the legal agreement between you ("the Member") and Carvado regarding your Membership.
Whilst these Terms are intended to provide legal certainty, they have also been written with clarity in mind. Wherever possible, plain English has been used instead of unnecessary legal terminology so that Members can understand both their rights and their responsibilities.
By purchasing, activating, renewing or otherwise using a Drivers Club Membership you confirm that you have read, understood and agreed to these Terms together with any policies referred to within them.
If you do not agree with these Terms you should not purchase or continue using a Membership.

1.1 Purpose
The purpose of these Terms is to explain the contractual relationship between Carvado and each Member of the Drivers Club.
These Terms describe the rights, obligations and responsibilities of both parties and establish how Membership operates.
They also explain the rules governing Membership Benefits, payments, renewals, transfers, cancellations, digital content, insurance review services and other services provided under the Drivers Club programme.
These Terms are intended to create a fair and transparent agreement for all Members while allowing the Drivers Club programme to evolve responsibly over time.
1.2 Who We Are
Drivers Club is operated by Carvado.
Throughout these Terms, references to "Carvado", "we", "our" or "us" refer to the organisation responsible for providing the Membership programme together with any authorised successor business operating the programme in the future.
References to "you" or "Member" refer to the individual who has entered into the Membership Agreement with Carvado.
1.3 Scope
These Terms apply to every Membership purchased through Carvado unless an alternative written agreement expressly states otherwise.
These Terms continue to apply throughout the duration of the Membership, including any renewal period, unless replaced by an updated version in accordance with Section 29.
Nothing within these Terms affects any statutory rights that cannot legally be excluded under applicable consumer legislation.

By becoming a Member you agree that Carvado may communicate with you electronically regarding your Membership.
Communications may include:

1.6 Interpretation
Headings are provided for convenience only and do not affect interpretation.
Words importing the singular include the plural and vice versa where the context permits.
References to legislation include amendments, replacements and successor legislation.
References to one gender include all genders.
References to a person include individuals, companies, partnerships and other legal entities where appropriate.
The words "including", "includes" and "for example" are illustrative only and do not limit the general meaning of the wording that precedes them.
1.7 Good Faith
Both Carvado and Members agree to exercise their respective rights under these Terms honestly, reasonably and in good faith.
Nothing within these Terms is intended to remove any legal rights or protections that either party may have under applicable law.

Registration of a Vehicle does not transfer Membership ownership to that Vehicle.
2.22 Interpretation of Related Policies
The Drivers Club legal library consists of multiple documents which are intended to work together.
Where another Drivers Club policy is referred to throughout these Terms, that policy forms part of the overall Membership framework.
Unless expressly stated otherwise:
- these Membership Terms & Conditions take precedence;
- individual policies expand upon specific operational areas;
- references to a policy include any replacement version published by Carvado from time to time.
Where wording appears inconsistent, these Membership Terms shall prevail except where applicable law requires otherwise.
3 ELIGIBILITY
3.1 Minimum Age
Membership is available only to individuals who are at least eighteen (18) years of age at the time the Membership Agreement is entered into.
By purchasing Membership, the Member confirms that they satisfy this requirement.
If Carvado reasonably believes that Membership has been obtained by someone under the required minimum age, Carvado reserves the right to suspend or terminate the Membership.
3.2 Residency
Membership is primarily intended for individuals resident within the United Kingdom.
Certain Membership services may also be available to customers resident in the Republic of Ireland where Carvado is able to provide those services.
Availability of particular Membership Benefits may depend upon geographic location, insurer availability or regulatory requirements.
3.3 Capacity
Members must have the legal capacity to enter into binding contracts.
Where Membership is purchased on behalf of another individual, the purchaser confirms that they have appropriate authority to do so.
3.4 Accurate Information
Members agree to provide accurate, complete and truthful information during the Membership application process.
Members are responsible for ensuring that information provided remains accurate throughout the Membership.
Where information materially changes, Members should update their account promptly.
Examples include changes to:
- Name
- Email address
- Telephone number
- Postal address
- Vehicles
- Renewal dates
- Other information reasonably required for Membership administration.
3.5 Identity Verification
Carvado reserves the right to verify a Member's identity where reasonably necessary.
Verification measures may include requesting supporting documentation or undertaking electronic verification checks.
Such checks are intended to protect Members and maintain the integrity of the Membership programme.
3.6 Acceptance of Membership
Submission of a Membership application does not automatically create a Membership Agreement.
Carvado reserves the right to decline or refuse Membership applications where reasonably necessary, including but not limited to circumstances involving suspected fraud, abuse, inaccurate information or regulatory requirements.
3.7 Existing Memberships
A Member may hold only one active Membership under the same email address unless expressly authorised by Carvado.
Where an application is submitted using an email address associated with an existing active or pending Membership, Carvado may prevent the creation of a duplicate Membership in order to avoid accidental duplicate subscriptions.
Where a customer genuinely wishes to purchase Membership for another individual, Carvado may provide the option to register that Membership using a different email address.
3.8 Business Use
Membership is intended primarily for personal use.
Commercial use of Membership Benefits, including using Membership services for the benefit of clients, customers or third parties in the course of business, is prohibited unless expressly authorised in writing by Carvado.
4 MEMBERSHIP AGREEMENT
4.1 Formation
The Membership Agreement is formed when Carvado accepts the Member's application and the Membership becomes active in accordance with these Terms.
Certain Membership Benefits may become available before full activation where stated during the checkout process.
4.2 Membership Duration
Membership continues until cancelled or terminated in accordance with these Terms.
Where Membership is purchased on a subscription basis, the minimum contractual commitment remains that stated at the point of purchase.
Unless otherwise stated, Membership automatically renews following completion of the minimum term in accordance with the Automatic Renewal Terms.
4.3 Membership Status
Throughout its lifecycle a Membership may hold one of several operational statuses.
These may include:
- Checkout Started
- Pending Payment
- Pending Direct Debit Confirmation
- Payment Processing
- Active
- Payment Recovery
- Suspended
- Cancellation Requested
- Scheduled to End
- Cancelled
- Expired
Additional operational statuses may be introduced where necessary to improve administration of the Membership programme.
4.4 Separate Insurance Contracts
Membership is separate from any insurance policy.
Insurance contracts remain contracts between the customer and the relevant insurer or intermediary.
Membership does not itself constitute insurance and should not be interpreted as an insurance contract.
4.5 No Guarantee of Insurance
Whilst Carvado may assist Members in sourcing insurance quotations and reviewing available options, Membership does not guarantee:
- Acceptance by any insurer.
- The availability of quotations.
- Lower premiums.
- Particular policy terms.
- Cover for any specific risk.
Insurance decisions remain entirely at the discretion of insurers and intermediaries.
4.6 Regulatory Compliance
Where regulated activities are undertaken, Carvado will conduct those activities in accordance with applicable regulatory requirements.
Nothing within these Terms limits any statutory protections available to consumers under applicable financial services legislation.
4.7 Entire Agreement
These Terms, together with the policies expressly incorporated by reference, constitute the entire Membership Agreement between Carvado and the Member.
No verbal statement, marketing material or informal communication shall form part of the Membership Agreement unless expressly confirmed in writing by Carvado.
5 MEMBERSHIP OWNERSHIP
5.1 Membership Ownership
Membership belongs to the Member and not to any individual Vehicle.
A Member may register, remove or update multiple Vehicles within their Member Dashboard at any time for administration purposes.
Registration of a Vehicle does not create a separate Membership, nor does it increase the number of Membership Benefits included within the selected Membership Tier.
5.2 Multiple Vehicles
Members may add multiple Vehicles to their account.
The number of insurance reviews included each Membership Year depends upon the selected Membership Tier.
Where the annual allowance has been used, additional insurance review services may be purchased separately at Carvado's prevailing rates.
Carvado reserves the right to introduce additional review packages or future Membership Tiers offering increased allowances.
5.3 Ownership Changes
If ownership of a registered Vehicle changes, the Member may remove that Vehicle and replace it with another.
Membership continues to belong to the Member regardless of which Vehicle is registered.
Membership does not automatically transfer with the sale or purchase of any Vehicle.
5.4 Membership Transfer
Carvado may, at its sole discretion, permit a Membership to be transferred to another individual.
Transfers may only take place where:
- the remaining Membership term transfers in full;
- the recipient satisfies the Membership eligibility requirements;
- Carvado has approved the transfer;
- any required verification has been completed.
5.5 Effect of Transfer
Where a Membership is transferred:
- the remaining Membership term transfers to the new Member;
- recurring subscription payments continue unless otherwise agreed;
- previously supplied one-time benefits do not restart;
- Welcome Packs are not reissued;
- previously claimed rewards remain with the original recipient;
- previously completed insurance reviews remain completed;
- downloaded digital content remains subject to its licence.
Only future unused Membership Benefits transfer to the new Member.
5.6 Prohibited Transfers
Membership may not be sold, auctioned, commercially assigned or transferred for financial gain without Carvado's prior written consent.
Unauthorised transfers may result in suspension or termination.
6 MEMBERSHIP TIERS
6.1 Membership Structure
Carvado may offer multiple Membership Tiers.
Each tier includes its own combination of services, benefits and support.
Membership Benefits are determined solely by the selected Membership Tier.
6.2 Drivers Club
Drivers Club provides the entry-level Membership.

- one included annual insurance review;
- access to digital member resources;
- Member Dashboard access;

- telephone support;
- enhanced member guidance;
- additional member resources;
- priority access to selected services.
6.4 Drivers Club Elite
Drivers Club Elite includes the benefits advertised for that Membership Tier.
Unless otherwise stated, Elite Members receive unlimited insurance review requests submitted through Carvado, subject always to the Fair Use Policy.
Unlimited reviews do not guarantee insurer acceptance, quotations or pricing.
6.5 Elite Black
Elite Black is a premium Membership available only by invitation or successful application.
Membership is not automatically available through public purchase.
Carvado reserves the right to accept or decline Elite Black applications at its absolute discretion.
Acceptance into Elite Black does not create any entitlement to future renewal or continued acceptance.
6.6 Future Membership Tiers
Carvado may introduce additional Membership Tiers from time to time.
Future Membership Tiers may include additional services, revised benefits or alternative pricing structures.
Members will not automatically be transferred into a different Membership Tier without their agreement.
6.7 Tier Changes
Members may request to upgrade or downgrade their Membership.
Changes may take effect immediately, at the next renewal date or at another time determined by Carvado.
Additional charges or credits may apply depending upon the timing of the change.
6.8 Tier Availability
Certain Membership Tiers may not always be available.
Carvado reserves the right to withdraw, suspend or replace Membership Tiers where reasonably necessary.
Existing contractual rights of active Members will be respected.
7 MEMBERSHIP BENEFITS
7.1 General
Membership Benefits are provided solely for the benefit of the Member.
Benefits are personal and may not be shared, resold or commercially exploited except where expressly authorised.
7.2 Benefit Availability
Benefits become available according to the Member's status.
Certain benefits become available immediately.
Others become available only after successful payment confirmation.
Physical items may be dispatched only after the first successful payment has been confirmed.
7.3 Changes to Benefits
Carvado continually develops and improves its Membership offering.
Accordingly, Membership Benefits may change from time to time.
Changes may include:
- adding new benefits;
- replacing existing benefits;
- improving digital resources;
- introducing additional partner offers;
- changing operational processes;
- improving support methods.
Where material contractual changes occur, Carvado will act fairly and in accordance with applicable law.
7.4 Personal Use
Membership Benefits are intended solely for the personal use of the Member.
Benefits may not be used:
- on behalf of clients;
- within another business;
- for brokerage services;
- for commercial resale;
- for automated bulk requests;
- or for any purpose inconsistent with these Terms.
7.5 Availability
Certain Membership Benefits depend upon:
- insurer availability;
- partner availability;
- regulatory requirements;
- geographical location;
- operational capacity;
- third-party suppliers.
Carvado cannot guarantee uninterrupted availability of every Membership Benefit at all times.
7.6 Promotional Benefits
From time to time Carvado may provide additional promotional benefits.
Unless expressly stated otherwise, promotional benefits do not become permanent contractual Membership Benefits and may be withdrawn or replaced at any time.
7.7 Third-Party Benefits
Some Membership Benefits may be supplied by carefully selected third parties.
Those third parties remain responsible for their own products and services.
Carvado is not responsible for failures or delays caused solely by third-party providers, although Carvado will seek to assist Members wherever reasonably possible.
8 INSURANCE REVIEW SERVICES
8.1 Purpose
One of the core Membership Benefits provided by Carvado is the ability for eligible Members to request Insurance Reviews.
The purpose of an Insurance Review is to assist Members in exploring suitable insurance options using insurers, brokers, specialist providers and available insurance markets known to Carvado at the time of the review.
Insurance Reviews are intended to provide guidance and assistance throughout the Member's ownership journey and should not be interpreted as a guarantee of insurance availability or pricing.
8.2 Nature of the Service
Insurance Reviews are carried out using information supplied by the Member together with information reasonably available to Carvado.
Carvado may:
- review available insurance markets;
- compare insurers and intermediaries;
- contact specialist providers;
- consider alternative policy structures;
- identify potential savings opportunities;
- recommend suitable insurance solutions where available;
- explain differences between available products;
- provide general guidance regarding insurance options.
The exact process may vary depending upon the Member's circumstances.
8.3 No Guarantee
Insurance Reviews are advisory in nature.
Carvado cannot and does not guarantee:
- that insurance will be available;
- that quotations will be obtained;
- that lower premiums will be identified;
- that any insurer will accept an application;
- that an insurer will continue to offer cover after a quotation has been obtained;
- that policy terms will remain unchanged;
- that premiums will remain available for any particular period.
Insurance premiums are determined entirely by insurers using their own underwriting criteria.
8.4 Information Provided by Members
Insurance Reviews depend upon accurate information supplied by the Member.
Members are responsible for ensuring that all information submitted to Carvado is complete, accurate and truthful.
This includes, where applicable:
- personal information;
- vehicle information;
- claims history;
- driving convictions;
- occupation;
- annual mileage;
- modifications;
- overnight parking arrangements;
- licence information;
- previous insurance history;
- any other information reasonably requested.
Carvado accepts no responsibility for quotations affected by inaccurate, incomplete or misleading information supplied by the Member.
8.5 Member Decisions
The final decision regarding whether to purchase any insurance product always remains with the Member.
Members remain responsible for:
- reviewing quotations;
- reading policy documentation;
- checking policy wording;
- confirming information supplied to insurers;
- ensuring purchased policies meet their own requirements.
Nothing within an Insurance Review constitutes legal advice, tax advice or financial advice.
8.6 Third-Party Providers
Insurance Reviews frequently involve communication with third-party insurers, brokers and intermediaries.
Those organisations remain independently responsible for:
- underwriting decisions;
- policy wording;
- premium calculations;
- policy administration;
- claims handling;
- complaints relating to insurance policies.
Carvado cannot accept responsibility for decisions made independently by third-party providers.
8.7 Insurance Review Allowances
The number of Insurance Reviews included each Membership Year depends upon the Member's selected Membership Tier.
Current allowances are described within the Membership Benefits Schedule.
Unused annual review allowances do not automatically carry forward into future Membership Years unless expressly stated otherwise.
8.8 Additional Reviews
Where a Member has used their included annual review allowance, additional Insurance Reviews may be purchased separately.
The applicable fee shall be the fee displayed or communicated by Carvado at the time of purchase.
Purchase of additional Insurance Reviews does not alter the Member's underlying Membership Tier.
8.9 Fair Use
Unlimited Insurance Reviews offered within certain Membership Tiers remain subject to the Fair Use Policy.
Examples of excessive or unreasonable use may include:
- repeated unnecessary requests for the same Vehicle without material changes;
- requests made on behalf of multiple unrelated third parties;
- automated or bulk submissions;
- commercial use;
- conduct intended to place unreasonable demands upon Carvado's resources.
Where Fair Use concerns arise, Carvado will normally discuss the matter with the Member before taking any action.
8.10 Availability
Insurance Reviews are provided subject to operational capacity.
Whilst Carvado aims to complete reviews promptly, turnaround times cannot be guaranteed and may vary depending upon:
- insurer response times;
- complexity;
- seasonal demand;
- public holidays;
- regulatory requirements;
- technical issues;
- information supplied by the Member.
9 MEMBER DASHBOARD
9.1 Purpose
Each Member is provided with access to a secure online Member Dashboard.
The Dashboard forms the central location from which Members may access and manage their Membership.
Carvado may introduce additional Dashboard functionality from time to time without requiring amendment to these Terms.
9.2 Dashboard Features
Depending upon the Member's Membership Tier and current Membership status, the Dashboard may include:
- Membership information;
- Membership status;
- Membership renewal date;
- payment history;
- invoices;
- downloadable digital resources;
- Welcome Pack status;
- registered Vehicles;
- Insurance Review history;
- referral information;
- referral rewards;
- account settings;
- profile management;
- support requests;
- announcements;
- event invitations;
- future Membership Benefits.
Additional features may be introduced over time.
9.3 Security
Members are responsible for maintaining the confidentiality of their login credentials.
Members must not knowingly allow another person to access their Dashboard using their account.
Where a Member believes unauthorised access has occurred, Carvado should be notified without unreasonable delay.
9.4 Dashboard Availability
Carvado aims to maintain high availability of the Dashboard.
However, temporary interruptions may occur due to:
- maintenance;
- software updates;
- security improvements;
- technical failures;
- internet outages;
- third-party hosting issues;
- events outside Carvado's reasonable control.
Temporary unavailability does not automatically constitute a breach of these Terms.
9.5 Account Updates
Members are responsible for keeping account information current.
Changes may include:
- address;
- telephone number;
- email address;
- registered Vehicles;
- renewal dates;
- communication preferences;
- other relevant Membership information.
9.6 Dashboard Suspension
Where Membership is suspended, certain Dashboard functions may be restricted.
Carvado may continue to provide access to information reasonably required by the Member, including payment history or statutory documentation, even during suspension.
10 DIGITAL CONTENT
10.1 Licence
Digital Content supplied through Membership is licensed to the Member for personal use only.
Ownership of Digital Content remains with Carvado or the relevant rights holder.
10.2 Types of Digital Content
Digital Content may include:
- Driver Handbooks;
- insurance guides;
- claims guidance;
- educational material;
- videos;
- checklists;
- templates;
- downloadable documents;
- future resources created by Carvado.
10.3 Downloads
Where downloads are permitted, Members may save copies onto their own personal devices.
Downloaded copies remain subject to these Terms.
10.4 Dashboard Access
Digital Content remains accessible through the Member Dashboard whilst Membership remains active, subject to maintenance, licensing restrictions and technical availability.
10.5 Restrictions
Members must not:
- resell Digital Content;
- publish Digital Content publicly;
- distribute Digital Content commercially;
- remove copyright notices;
- modify Digital Content for commercial purposes;
- upload Digital Content to file-sharing services for public access.
Reasonable personal printing and storage is permitted.
10.6 Future Updates
Carvado may revise, replace or improve Digital Content over time.
Members may receive updated versions where appropriate.
11 WELCOME PACKS
11.1 Eligibility
Where a Membership Tier includes a Welcome Pack, fulfilment will begin only after the first successful Membership payment has been confirmed.
Submission of a Membership application alone does not create an entitlement to receive a Welcome Pack.
11.2 Dispatch
Carvado will use reasonable endeavours to dispatch Welcome Packs within a reasonable period after eligibility has been confirmed.
Delivery times are estimates only.
11.3 One-Time Benefit
Welcome Packs are a one-time Membership Benefit.
They are issued once per Membership and are not renewed upon:
- Membership transfer;
- Membership renewal;
- changes of address;
- replacement Vehicles;
- replacement account holders.
11.4 Transfer of Membership
Where Membership is transferred to another eligible individual, previously supplied Welcome Packs do not transfer as an additional entitlement.
The remaining Membership term transfers.
Previously consumed one-time benefits do not.
11.5 Delivery
Members are responsible for ensuring that delivery details remain accurate.
Carvado cannot accept responsibility for failed deliveries resulting from incorrect address information supplied by the Member.
11.6 Changes
Carvado reserves the right to improve, replace or modify Welcome Pack contents from time to time.
The contents of any Welcome Pack do not form a permanent contractual entitlement unless expressly stated otherwise.
12 MEMBERSHIP FEES
12.1 Membership Fees
Membership Fees are payable in consideration of the Membership Benefits provided by Carvado.
The applicable Membership Fee is the fee displayed to the Member during the checkout process immediately before purchase.
Membership Fees may differ between Membership Tiers.
12.2 Changes to Membership Fees
Carvado may amend Membership Fees for future Memberships or future renewal periods.
Any change to a recurring Membership Fee will be communicated to affected Members before the change takes effect.
Nothing within this clause permits Carvado to increase fees retrospectively for an existing paid Membership period.
12.3 Taxes
Unless expressly stated otherwise, all Membership Fees displayed include any taxes which Carvado is legally required to charge.
Where tax treatment changes due to legislation, Carvado reserves the right to amend displayed pricing accordingly.
12.4 Additional Services
Certain services may be available in addition to the standard Membership Benefits.
Examples may include:
- additional Insurance Reviews;
- premium consultations;
- specialist administration services;
- vehicle-related services;
- future Membership upgrades;
- optional products.
Unless expressly stated otherwise, these additional services are charged separately from the Membership Fee.
12.5 Promotional Pricing
From time to time Carvado may offer promotional Membership pricing.
Promotional pricing:
- applies only during the stated promotional period;
- cannot normally be applied retrospectively;
- cannot normally be combined with other offers unless expressly stated.
Expiry of a promotional offer does not create any entitlement for existing Members to continue receiving that offer beyond its stated duration.
12.6 Currency
Membership Fees are charged in Pounds Sterling (GBP) unless expressly stated otherwise.
Members are responsible for any exchange rate fluctuations or charges imposed by their own financial institution.
12.7 Failure to Pay
Failure to pay Membership Fees may result in:
- payment recovery attempts;
- temporary restriction of Membership Benefits;
- suspension;
- cancellation following the Recovery Process.
Failure to pay does not automatically end the Membership Agreement.
Outstanding contractual obligations may continue until Membership is properly terminated in accordance with these Terms.
13 PAYMENT METHODS
13.1 General
Membership Fees are collected using payment methods approved by Carvado.
Available payment methods may change from time to time.
The payment methods displayed during checkout form the available methods at the time of purchase.
13.2 Recurring Payments
By purchasing a recurring Membership, the Member authorises Carvado (or its authorised payment processor) to collect recurring Membership Fees using the selected payment method until the Membership ends in accordance with these Terms.
13.3 Direct Debit
Where Membership is purchased using Direct Debit:
- the Member authorises recurring collection of Membership Fees;
- payments will normally be collected on or around the agreed collection date;
- collections remain subject to banking processes outside Carvado's control.
Activation of certain Membership Benefits may depend upon successful confirmation of the initial payment.
13.4 Card Payments
Where card payments are available, recurring charges may be collected using the payment card authorised by the Member.
Members remain responsible for ensuring that payment details remain valid throughout the Membership.
13.5 Payment Processing
Payments are processed using authorised third-party payment providers.
Carvado does not store full payment card information.
Payment providers may carry out fraud prevention, security verification and authentication procedures before accepting payments.
13.6 Failed Payments
Where a recurring Membership payment cannot be collected, Carvado will normally attempt to recover the payment.
Recovery attempts may include:
- notifying the Member;
- requesting updated payment details;
- automatically retrying collection;
- temporarily restricting Membership Benefits where appropriate.
13.7 Payment Retries
Where a Direct Debit or recurring payment fails, Carvado will normally make further collection attempts.
The number and timing of retry attempts may vary depending upon operational procedures, payment provider requirements and banking rules.
Repeated payment failure may result in progression to the Recovery Process.
13.8 Recovery Process
Where payment remains outstanding after reasonable retry attempts, Carvado may:
- suspend Membership Benefits;
- continue attempting lawful recovery;
- contact the Member regarding outstanding payments;
- terminate Membership where appropriate;
- take any other lawful action reasonably necessary to recover contractual sums due.
Further information regarding payment recovery is contained within the Recovery Terms.
13.9 Member Responsibilities
Members remain responsible for ensuring:
- payment methods remain valid;
- sufficient funds are available;
- payment details remain current;
- expired payment methods are updated promptly.
Carvado accepts no responsibility for Membership interruption resulting solely from invalid payment details supplied by the Member.
13.10 Chargebacks
If a Member disputes or reverses a payment through their payment provider without first contacting Carvado to resolve the issue, Carvado reserves the right to:
- investigate the dispute;
- suspend Membership during investigation;
- recover any unpaid contractual sums;
- restrict future purchases where fraudulent or abusive activity is identified.
Nothing within this clause limits the Member's legal rights to dispute genuinely unauthorised transactions.
13.11 Payment Security
Carvado takes reasonable steps to ensure that payment information is processed securely.
Payment processing may be carried out by regulated third-party providers using encrypted communication channels.
Whilst Carvado takes reasonable precautions, no internet-based payment system can be guaranteed to be entirely free from risk.
14 AUTOMATIC RENEWAL
14.1 Subscription Model
Drivers Club Membership operates on a recurring subscription basis.
Following completion of the applicable minimum Membership Term, Membership will continue automatically unless cancelled in accordance with these Terms and the Automatic Renewal Terms.
14.2 Purpose of Automatic Renewal
Automatic Renewal is intended to ensure uninterrupted access to Membership Benefits.
Without automatic renewal, Members could lose access to digital resources, support services and other Membership Benefits simply because a renewal date was overlooked.
14.3 Renewal Notice
Where required by applicable law or good industry practice, Carvado will provide reasonable notice before recurring renewal payments are collected.
Renewal reminders may be delivered by:
- email;
- Dashboard notifications;
- other electronic communication methods.
14.4 Member Responsibility
Members remain responsible for ensuring that:
- contact information remains current;
- payment methods remain valid;
- renewal notifications can be received.
Failure to read a renewal reminder does not automatically prevent renewal where the Membership Agreement provides for recurring payments.
14.5 Continuous Membership
Provided payments continue successfully, Membership continues without interruption.
Continuous Membership may preserve eligibility for certain Membership Benefits which depend upon uninterrupted Membership.
14.6 Cancellation Before Renewal
Members who do not wish their Membership to renew may request cancellation in accordance with the Cancellation Policy.
Cancellation requests received during the minimum contractual term do not normally end the Membership immediately but instead prevent renewal after completion of that minimum term unless otherwise required by law.
14.7 Failed Renewal Payments
If a renewal payment cannot be collected, Carvado will normally follow the Recovery Process before considering suspension or termination.
Members may continue receiving limited access during the recovery period where operationally appropriate.
14.8 Changes Before Renewal
Carvado may make reasonable operational or pricing changes before future renewal periods.
Where required, Members will receive appropriate notice before such changes take effect.
14.9 No Obligation to Renew
Although Membership normally renews automatically, Carvado reserves the right not to offer renewal in exceptional circumstances including:
- fraud;
- serious breach of these Terms;
- unlawful activity;
- repeated abusive conduct;
- regulatory requirements;
- permanent withdrawal of the relevant Membership Tier.
Where reasonably practicable, Carvado will notify the Member if renewal will not be offered.
15 COOLING-OFF RIGHTS
15.1 Your Statutory Rights
Where applicable, consumers may have statutory cancellation rights under UK consumer legislation when purchasing Membership online or by another distance-selling method.
Nothing within these Terms removes or limits any statutory rights which cannot legally be excluded.
15.2 Immediate Access Request
During the Membership checkout process, Members expressly request immediate access to Membership Benefits before the expiry of any statutory cooling-off period.
These benefits may include, where applicable:
- activation of the Member Dashboard;
- access to Digital Content;
- downloadable handbooks and resources;
- insurance review services;
- messaging support;
- telephone support;
- referral programme participation;
- member-only offers;
- other Membership Benefits included within the selected Membership Tier.
15.3 Effect of Immediate Access
Where immediate access has been requested and provided, any refund entitlement may be reduced to reflect the value of Membership Benefits already supplied in accordance with applicable consumer legislation.
Depending upon the extent of services already provided, this may result in no refund being payable.
15.4 Digital Content
Where Digital Content has been supplied immediately following purchase, Members acknowledge that such content may be immediately accessible and downloadable.
Downloaded Digital Content remains licensed rather than sold.
15.5 Cooling-Off Requests
Members wishing to exercise any applicable statutory cancellation rights should contact Carvado as soon as reasonably possible.
Each request will be assessed individually in accordance with applicable legislation and these Terms.
16 CANCELLATION
16.1 Minimum Membership Term
Unless expressly stated otherwise, Drivers Club Membership is purchased subject to a minimum Membership Term of twelve (12) consecutive months.
By completing the Membership purchase, the Member agrees to remain liable for the Membership Fees applicable throughout that minimum contractual period.
16.2 Requesting Cancellation
Members may notify Carvado at any time that they do not wish their Membership to renew.
Unless otherwise required by law, cancellation requests received during the minimum Membership Term do not immediately end the Membership.
Instead, the Membership will continue until completion of the agreed minimum term before ending.
16.3 Membership Benefits During the Minimum Term
Where a cancellation request is received before completion of the minimum Membership Term, the Member will normally continue receiving Membership Benefits until the Membership ends.
This includes access to the Member Dashboard, Digital Content, support services and any other benefits included within the applicable Membership Tier, subject always to these Terms.
16.4 No Automatic Refund
Membership Fees are paid in consideration of continuous access to Membership Benefits throughout the Membership.
Where Membership Benefits have already been supplied, Carvado will not normally provide refunds simply because a Member decides they no longer wish to continue using the Membership.
Any statutory rights remain unaffected.
16.5 Voluntary Early Termination
Carvado may, at its absolute discretion, agree to end a Membership before completion of the minimum Membership Term.
Where such agreement is given, Carvado reserves the right to determine any financial adjustment, refund or outstanding balance appropriate in the circumstances.
Nothing within this clause creates an entitlement to early termination.
16.6 Outstanding Payments
Cancellation of Membership does not remove liability for Membership Fees already contractually due.
Outstanding Membership Fees remain payable even where Membership Benefits have been suspended.
16.7 Effect of Cancellation
Upon cancellation taking effect:
- recurring payments will cease;
- Dashboard access may be restricted;
- future Membership Benefits will cease;
- access to member-only offers may end;
- insurance review allowances will expire;
- future Welcome Pack entitlements (if any) will cease.
16.8 Downloaded Content
Digital Content previously downloaded onto a Member's personal device may remain available for that Member's own personal use, subject to the licence granted under these Terms.
Continued access through the Member Dashboard normally ends once Membership is no longer active.
16.9 Rejoining
Former Members are welcome to apply for Membership again in the future.
Carvado reserves the right to determine:
- applicable pricing;
- eligibility;
- available Membership Tiers;
- Welcome Pack entitlement;
- promotional eligibility.
Rejoining Membership does not automatically restore previous promotional benefits.
17 MEMBERSHIP TRANSFERS
17.1 Transfer Requests
Members may request that their Membership be transferred to another eligible individual.
Transfers are not automatic and remain subject to Carvado's approval.
17.2 Eligibility
The proposed recipient must satisfy the Membership eligibility requirements applicable at the time of transfer.
Carvado may request reasonable information in order to verify eligibility before approving any transfer.
17.3 Remaining Membership Term
Where a transfer is approved, the remaining Membership Term transfers to the new Member.
A transfer does not restart the Membership period.
Example:
If six months remain on the Membership, the recipient receives the remaining six months.
17.4 Membership Benefits
Any unused future Membership Benefits transfer together with the Membership.
Benefits already consumed by the original Member do not become available again.
Examples include:
- previously completed insurance reviews;
- Welcome Packs already dispatched;
- redeemed promotional offers;
- referral rewards already paid;
- one-time Member gifts;
- previously consumed benefits.
17.5 Dashboard
Following an approved transfer, Carvado may create or update the recipient's Member Account so that future Membership Benefits are associated with the new Member.
Historic account records may remain associated with the original Member where reasonably necessary for legal, accounting or operational purposes.
17.6 Refusal of Transfer
Carvado may refuse a transfer where it reasonably believes:
- fraudulent activity may be involved;
- inaccurate information has been supplied;
- eligibility requirements are not satisfied;
- the Membership is already subject to suspension or termination;
- transfer would breach applicable law.
18 MEMBER RESPONSIBILITIES
18.1 General Standard
Members are expected to use Drivers Club responsibly, honestly and in accordance with these Terms.
Drivers Club has been created to provide long-term value for all Members.
Accordingly, Members agree not to misuse Membership Benefits or intentionally interfere with the operation of the Membership programme.
18.2 Accurate Information
Members remain responsible for ensuring that all information supplied to Carvado remains accurate and up to date.
Where material information changes, Members should notify Carvado within a reasonable period.
18.3 Security
Members are responsible for maintaining the security of their login credentials.
Passwords should not be shared with other individuals.
Members must take reasonable precautions to prevent unauthorised access to their Member Account.
18.4 Lawful Use
Members agree to use Membership only for lawful purposes.
Membership must not be used:
- fraudulently;
- dishonestly;
- in breach of applicable law;
- in a manner likely to damage Carvado's reputation;
- to harass or abuse Members of staff;
- to interfere with the operation of the Membership programme.
18.5 Respectful Conduct
Carvado is committed to providing a professional and respectful service.
Members are expected to communicate with Carvado staff respectfully.
Abusive, threatening, discriminatory or intimidating behaviour may result in suspension or termination in accordance with these Terms.
18.6 Fair Use
Members agree to use Membership Benefits reasonably.
Where unlimited services are included within a Membership Tier, those services remain subject to the Fair Use Policy.
The Fair Use Policy is intended to ensure that all Members receive a consistently high standard of service.
19 FAIR USE
19.1 Purpose
Drivers Club has been designed to provide Members with ongoing value throughout their Membership.
Certain Membership Tiers include enhanced or unlimited services. These services are provided on the basis that they will be used reasonably and in good faith.
The purpose of the Fair Use Policy within these Terms is not to restrict genuine Members from making proper use of their Membership, but rather to protect the quality, availability and sustainability of the Membership programme for all Members.
19.2 Reasonable Use
Reasonable use will depend upon the nature of the Membership Benefit being used.
In determining whether usage remains reasonable, Carvado may consider factors including:
- frequency of requests;
- complexity of requests;
- the time required to fulfil requests;
- previous usage;
- the Member's Membership Tier;
- operational capacity;
- whether requests appear genuine.
No single factor will automatically determine unreasonable use.
19.3 Unlimited Services
Where a Membership Tier advertises unlimited services, "unlimited" means there is no predetermined numerical limit on legitimate requests made by the Member for their own personal use.
Unlimited does not mean unlimited staff time, unlimited commercial use or unlimited requests regardless of reasonableness.
Unlimited services remain subject to these Terms and the Fair Use Policy.
19.4 Examples of Reasonable Use
Examples of reasonable use may include:
- requesting assistance when genuinely required;
- requesting insurance reviews for the Member's own vehicles;
- contacting support with genuine Membership enquiries;
- accessing Digital Content for personal education;
- participating in Membership events where eligible;
- making proper use of Member benefits.
19.5 Examples of Unreasonable Use
Examples of unreasonable use may include:
- repeatedly submitting identical requests without material changes;
- deliberately overwhelming support channels;
- using Membership for commercial purposes without permission;
- requesting services on behalf of multiple unrelated individuals;
- using automated systems to generate requests;
- abusive or threatening behaviour towards staff;
- attempting to bypass Membership limits through multiple accounts;
- intentionally consuming disproportionate operational resources.
The above examples are illustrative only.
19.6 Fair Resolution
Where Carvado believes usage may be inconsistent with this Policy, Carvado will normally seek to resolve the matter informally before taking any formal action.
This may include:
- discussing usage with the Member;
- suggesting alternative solutions;
- temporarily delaying further requests;
- agreeing reasonable limits.
Immediate action may however be taken where fraud, abuse or unlawful conduct is reasonably suspected.
20 CARVADO RESPONSIBILITIES
20.1 Our Commitment
Carvado is committed to providing a professional Membership service which is continually developed and improved.
We aim to provide Members with reliable support, practical guidance and valuable Membership Benefits throughout the Membership period.
20.2 Reasonable Skill and Care
Carvado will exercise reasonable skill and care when providing Membership services.
Nothing within these Terms guarantees perfection or uninterrupted availability, however Members can expect services to be delivered professionally and honestly.
20.3 Continuous Improvement
Drivers Club is intended to evolve over time.
Carvado may introduce:
- new Membership Benefits;
- improved Dashboard functionality;
- additional Digital Content;
- improved member communications;
- new partnerships;
- additional services;
- operational improvements.
Our objective is to improve the Membership experience wherever reasonably possible.
20.4 Member Communications
Carvado aims to communicate clearly regarding:
- Membership status;
- payment information;
- important changes;
- operational updates;
- scheduled maintenance;
- Membership renewals;
- significant new Membership Benefits.
20.5 Security
Carvado takes reasonable technical and organisational measures to protect Member information and Membership systems.
Whilst no online service can ever guarantee complete security, Carvado continually reviews security measures appropriate to the Membership programme.
20.6 Customer Support
Carvado aims to respond to Member enquiries within reasonable timeframes.
Response times may vary depending upon:
- enquiry complexity;
- Membership Tier;
- operational demand;
- public holidays;
- circumstances outside Carvado's reasonable control.
Estimated response times do not form contractual guarantees.
20.7 Service Development
Carvado reserves the right to improve the Drivers Club programme without requiring Member consent where those improvements do not materially reduce contractual rights.
Examples include:
- redesigning the Dashboard;
- introducing new technologies;
- improving payment systems;
- enhancing Member communications;
- replacing outdated processes.
21 LIMITATIONS OF SERVICE
21.1 Nature of Membership
Drivers Club is a Membership programme.
It is not an insurance policy.
Membership should never be interpreted as providing insurance cover.
21.2 Independent Decisions
Insurance providers remain independently responsible for:
- underwriting decisions;
- premium calculations;
- policy wording;
- claims decisions;
- policy administration.
Carvado cannot influence or guarantee those decisions.
21.3 Third Parties
Certain Membership Benefits rely upon third-party providers.
Although Carvado carefully selects partners where appropriate, Carvado cannot guarantee:
- continued availability;
- pricing;
- performance;
- delivery times;
- future participation.
21.4 Availability
Whilst Carvado aims to provide uninterrupted Membership services, temporary interruptions may occur due to:
- scheduled maintenance;
- emergency maintenance;
- software upgrades;
- internet outages;
- cyber incidents;
- supplier failures;
- payment provider outages;
- hosting failures;
- events outside Carvado's reasonable control.
Temporary interruptions do not automatically constitute a breach of these Terms.
21.5 Advice
Information supplied through Drivers Club is intended to assist Members.
Unless expressly stated otherwise, Membership services should not be interpreted as legal advice, taxation advice or regulated financial advice.
Members remain responsible for making their own purchasing decisions.
21.6 Future Services
Carvado may develop additional services in future.
Unless expressly included within a Membership Tier, future services do not automatically become contractual Membership Benefits.
22 SUSPENSION
22.1 Right to Suspend
Carvado may suspend a Membership where reasonably necessary.
Suspension is intended to protect Members, Carvado and the integrity of the Membership programme.
22.2 Reasons for Suspension
Suspension may occur where Carvado reasonably believes:
- Membership Fees remain unpaid;
- payment recovery is underway;
- fraudulent activity may have occurred;
- false information has been supplied;
- these Terms have been materially breached;
- the Fair Use Policy has been seriously breached;
- unlawful activity is suspected;
- Member conduct presents an unacceptable risk to staff or other Members;
- suspension is required to comply with applicable law or regulation.
22.3 Effect of Suspension
Whilst suspended, some or all Membership Benefits may be unavailable.
Examples include:
- Dashboard functionality;
- support services;
- Insurance Reviews;
- Digital Content;
- referral rewards;
- event bookings.
Operational records will normally remain available for administrative purposes.
22.4 Member Notification
Where reasonably practicable, Carvado will notify the Member of the suspension and explain the general reason for that decision.
Immediate suspension without prior notice may occur where necessary to protect Members, staff, systems or third parties.
22.5 Suspension is not Cancellation
Suspension does not automatically terminate the Membership Agreement.
Membership Fees may continue to fall due during suspension where the underlying Membership Agreement remains active.
22.6 Reinstatement
Where the reason for suspension has been resolved, Carvado may reinstate the Membership.
Examples include:
- successful payment recovery;
- verification of identity;
- correction of inaccurate information;
- resolution of misunderstandings;
- conclusion of an investigation.
Reinstatement remains at Carvado's discretion, having regard to the circumstances of each case.
22.7 Serious Misconduct
Nothing within this section prevents Carvado from terminating Membership immediately where the circumstances justify immediate termination under these Terms.
23 TERMINATION
23.1 General
Whilst Carvado hopes every Membership will continue successfully throughout its full duration, there may be circumstances where a Membership comes to an end.
Termination may occur:
- by the Member in accordance with these Terms;
- by Carvado in accordance with these Terms;
- following completion of the Membership where renewal does not occur;
- where required by applicable law.
Termination should be distinguished from suspension.
Suspension is normally intended to be temporary.
Termination permanently ends the Membership Agreement unless a new Membership is purchased.
23.2 Termination by the Member
Members may terminate their Membership in accordance with the Cancellation Policy.
Where a minimum Membership Term applies, termination will normally take effect only after completion of that minimum contractual period unless:
- applicable law provides otherwise;
- Carvado expressly agrees otherwise in writing.
23.3 Termination by Carvado
Carvado reserves the right to terminate Membership where reasonably necessary.
Examples include:
- deliberate fraud;
- attempted fraud;
- identity theft;
- repeated payment failure after completion of the Recovery Process;
- serious breach of these Terms;
- serious breach of the Fair Use Policy;
- abusive or threatening behaviour towards staff;
- criminal conduct affecting the Membership programme;
- misuse of Membership Benefits;
- unauthorised commercial exploitation of Membership;
- provision of knowingly false information;
- conduct likely to cause serious reputational damage to Carvado.
The above list is illustrative rather than exhaustive.
23.4 Immediate Termination
Carvado may terminate Membership immediately where the seriousness of the circumstances makes continued Membership unreasonable.
Examples may include:
- fraud;
- violent or threatening behaviour;
- unlawful activity;
- deliberate attempts to compromise Membership systems;
- repeated abuse following previous warnings.
23.5 Effect of Termination
Upon termination:
- Membership immediately ends;
- future Membership Benefits cease;
- recurring payments will cease once all contractual obligations have been satisfied;
- Member-only offers cease;
- future Insurance Reviews cease;
- future event eligibility ceases;
- future referral rewards cease unless already approved under the Referral Programme Terms.
Termination does not remove liability for sums already due.
23.6 Historic Records
Termination does not require Carvado to delete records which must be retained for legal, regulatory, taxation, accounting, fraud prevention or legitimate business purposes.
Such information will continue to be processed in accordance with the Privacy Policy and applicable legislation.
23.7 Future Membership Applications
Following termination, an individual may apply for Membership again unless Carvado has reasonably determined that future Membership should not be offered.
Carvado reserves the right to refuse future Membership applications where previous Membership was terminated due to fraud, abuse or other serious misconduct.
24 INTELLECTUAL PROPERTY
24.1 Ownership
All intellectual property rights relating to Drivers Club remain the property of Carvado or its licensors unless expressly stated otherwise.
This includes, without limitation:
- branding;
- logos;
- trademarks;
- designs;
- software;
- source code;
- databases;
- website content;
- graphics;
- downloadable resources;
- videos;
- guides;
- handbooks;
- educational materials;
- written content;
- photographs;
- marketing material.
Nothing within these Terms transfers ownership of those rights to Members.
24.2 Licence to Members
During an active Membership, Carvado grants the Member a limited, personal, non-exclusive, non-transferable and revocable licence to access and use Membership Benefits solely for personal use.
This licence automatically ends when Membership ends unless otherwise stated.
24.3 Restrictions
Members must not, without prior written permission:
- reproduce Membership materials commercially;
- publish Digital Content publicly;
- copy substantial parts of Membership resources;
- modify Carvado material for resale;
- create competing products using Membership resources;
- remove copyright notices;
- reverse engineer software provided through Membership where prohibited by law.
24.4 Member Content
Where Members submit photographs, testimonials, feedback or other content to Carvado, the Member confirms they have the necessary rights to submit that content.
Unless otherwise agreed, Members retain ownership of their own content.
By voluntarily submitting content to Carvado, Members grant Carvado a non-exclusive licence to use that content for Membership administration, customer support and, where permission has been given, marketing purposes.
24.5 Feedback
Suggestions, ideas and recommendations submitted by Members regarding Drivers Club may be considered by Carvado.
Unless otherwise agreed, Members acknowledge that Carvado may implement similar ideas without payment or compensation.
Nothing within this clause transfers ownership of independently protectable intellectual property belonging to the Member.
25 PRIVACY & DATA PROTECTION
25.1 Commitment
Carvado takes the privacy of Members seriously.
Personal information is handled in accordance with applicable data protection legislation together with Carvado's Privacy Policy.
25.2 Purpose of Processing
Member information may be processed for purposes including:
- Membership administration;
- payment processing;
- Member support;
- Insurance Reviews;
- account management;
- fraud prevention;
- regulatory compliance;
- security;
- communication;
- service improvement;
- legal obligations.
25.3 Privacy Policy
Further information regarding the collection, use, storage and protection of personal information is contained within the Privacy Policy.
The Privacy Policy forms part of the wider Drivers Club legal documentation but does not itself form part of the contractual payment obligations between Carvado and the Member.
25.4 Security
Carvado takes reasonable technical and organisational measures designed to protect Member information.
Whilst no online system can guarantee absolute security, Carvado continually reviews appropriate safeguards.
25.5 Member Responsibilities
Members should also take reasonable steps to protect their own information, including:
- maintaining secure passwords;
- protecting login credentials;
- using trusted devices;
- notifying Carvado of suspected unauthorised access.
26 COMPLAINTS
26.1 Commitment
Carvado aims to provide a high standard of service.
Where a Member is dissatisfied with any aspect of the Membership programme, Carvado encourages the Member to raise the matter as soon as reasonably possible.
26.2 Informal Resolution
Many concerns can be resolved quickly through discussion with the Membership Team.
Members are encouraged to contact Carvado before escalating a complaint wherever appropriate.
26.3 Formal Complaints
Where informal resolution is not possible, Members may submit a formal complaint in accordance with the Complaints Policy.
The Complaints Policy explains:
- how complaints may be submitted;
- expected response times;
- investigation procedures;
- escalation options;
- how final responses are issued.
26.4 Cooperation
Both Carvado and the Member agree to cooperate in good faith during any complaint investigation.
Providing accurate information promptly assists fair and timely resolution.
26.5 Complaints do not suspend contractual obligations
Unless otherwise required by law, submitting a complaint does not automatically suspend:
- Membership Fees;
- recurring payment obligations;
- the Membership Agreement.
Where appropriate, Carvado may agree temporary arrangements whilst a complaint is investigated.
26.6 Learning from Complaints
Carvado reviews complaints as part of its commitment to continuous improvement.
Feedback received through complaints may be used to improve Membership Benefits, operational processes, communications and customer service.
27 LIMITATION OF LIABILITY
27.1 Nothing in these Terms excludes or limits any liability which cannot lawfully be excluded or limited under applicable law.
This includes, without limitation, liability for:
- death or personal injury caused by negligence;
- fraud or fraudulent misrepresentation;
- any other liability which applicable law prohibits from being excluded.
27.2 Subject to clause 27.1, Carvado shall not be liable for any indirect, incidental, consequential or special loss arising out of or in connection with Membership, including but not limited to:
- loss of profit;
- loss of opportunity;
- loss of anticipated savings;
- loss of business;
- loss of contracts;
- loss of goodwill;
- business interruption;
- loss of data;
where such losses arise indirectly from the use of Membership.
27.3 Carvado provides Membership services using reasonable skill and care but cannot guarantee that:
- every insurer will provide quotations;
- every quotation will be cheaper;
- insurance will always be available;
- every digital service will remain continuously available;
- third-party services will always operate without interruption;
- websites or online systems will never experience downtime.
27.4 Carvado shall not be responsible for delays or failures caused by third parties including, without limitation:
- insurers;
- insurance brokers;
- finance providers;
- payment providers;
- delivery companies;
- internet service providers;
- cloud hosting providers;
- software suppliers;
- telecommunications providers;
provided that Carvado has acted with reasonable skill and care in selecting or using those providers.
27.5 Members acknowledge that decisions relating to insurance premiums, underwriting, policy wording, policy acceptance, claims handling and claims settlement are made solely by insurers and intermediaries.
Carvado accepts no responsibility for those independent commercial decisions.
27.6 Where Membership includes guidance, recommendations or educational material, Members remain responsible for making their own decisions.
Nothing within Membership guarantees any particular commercial or financial outcome.
27.7 Subject to applicable law, Carvado's total liability arising from Membership shall not exceed the total Membership Fees paid by the Member during the twelve months immediately preceding the event giving rise to the claim.
27.8 Nothing within this section affects any statutory consumer rights.
28 FORCE MAJEURE
28.1 Carvado shall not be liable for delay or failure to perform any obligation under these Terms where that delay or failure results from events beyond Carvado's reasonable control.
28.2 Such events may include, without limitation:
- acts of God;
- flood;
- fire;
- severe weather;
- pandemic;
- epidemic;
- war;
- terrorism;
- civil unrest;
- industrial disputes;
- interruption of utilities;
- internet outages;
- cyber attacks;
- software failures;
- failure of suppliers;
- governmental action;
- regulatory restrictions;
- changes in law;
- failure of payment systems;
- failure of communications infrastructure.
28.3 Where reasonably practicable, Carvado will notify Members of significant disruption and will use reasonable endeavours to restore normal service as soon as possible.
28.4 Force Majeure does not automatically terminate the Membership Agreement.
Where disruption continues for an extended period, Carvado may determine an appropriate course of action having regard to the interests of Members and the continued operation of Drivers Club.
29 CHANGES TO THESE TERMS
29.1 Drivers Club is intended to evolve over time.
Accordingly, Carvado reserves the right to amend these Terms where reasonably necessary.
29.2 Reasons for amendment may include:
- changes in legislation;
- regulatory requirements;
- improvements to Membership Benefits;
- operational improvements;
- technological developments;
- security improvements;
- correction of errors;
- clarification of wording;
- introduction of new Membership Tiers;
- introduction of additional Membership Benefits;
- changes to payment systems;
- changes to partner arrangements.
29.3 Where changes materially affect Members' contractual rights, Carvado will provide reasonable notice before those changes take effect where required by law.
29.4 Continued use of Membership after updated Terms become effective constitutes acceptance of those updated Terms except where applicable law provides otherwise.
29.5 Historic versions of these Terms may be retained by Carvado for regulatory, legal and operational purposes.
30 GOVERNING LAW
30.1 These Membership Terms and the Membership Agreement shall be governed by and interpreted in accordance with the laws of England and Wales.
30.2 Members resident within Scotland or Northern Ireland may also have additional legal rights available under applicable legislation.
30.3 Where Membership services are provided to Members resident within the Republic of Ireland, mandatory provisions of Irish consumer legislation shall continue to apply where required by law.
30.4 The courts of England and Wales shall normally have jurisdiction in relation to disputes arising under these Terms, subject always to any mandatory legal rights available to consumers.
31 CONTACT INFORMATION
31.1 Questions regarding Membership should be directed to the Carvado Membership Team.
Current contact details are published on the Carvado website and Member Dashboard.
31.2 Members are encouraged to contact Carvado promptly regarding:
- account enquiries;
- Membership updates;
- payment queries;
- Insurance Review requests;
- technical issues;
- complaints;
- suspected fraud;
- unauthorised account access;
- changes to personal information.
31.3 Carvado may update operational contact details from time to time without amending these Terms.
31.4 Interpretation
If any provision of these Membership Terms is found by a court or competent authority to be unlawful, invalid or unenforceable, the remaining provisions shall remain in full force and effect.
Any unenforceable provision shall, where possible, be interpreted or modified only to the extent necessary to make it enforceable whilst preserving its original commercial purpose.
Failure by Carvado to enforce any provision of these Terms shall not constitute a waiver of that provision or any other contractual right.
Any rights or remedies available to Carvado under these Terms are cumulative and do not exclude any rights available under applicable law.
